Welcome to Tempo. These Terms of Service ("Terms") constitute a legally binding agreement between you and Qingdao Tianji Intelligent Technology Co., Ltd. (青岛天机智能科技有限公司) ("we," "us," or "our") governing your access to and use of the Tempo mobile application ("App") and all related services.
By downloading, installing, or using Tempo, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
You must be at least 4 years of age (or the minimum age required in your jurisdiction) to use Tempo. By using the App, you represent that you meet this age requirement.
Tempo is an iOS habit tracking and Pomodoro focus timer application designed to help you build consistent habits and maintain focused work sessions. The App provides the following core features:
Tempo requires iOS 17.6 or later and an Apple device compatible with that operating system version.
Tempo uses your Apple iCloud account for authentication and data synchronization. You do not need to create a separate account to use the App.
By using Tempo, you agree that:
You may delete your data at any time through the App's settings. Account deletion will remove your local data and any associated CloudKit records.
Tempo offers a free tier with the following limitations:
Tempo Pro unlocks unlimited habits, unlimited groups, customizable timer durations, all ambient sounds, and full statistics history. The following subscription plans are available:

All purchases are processed by Apple. Refund requests must be submitted to Apple in accordance with their refund policies. We do not have the ability to process refunds directly. To request a refund, visit reportaproblem.apple.com.
Tempo Pro may offer a 7-day free trial for eligible users. The free trial provides full access to all Pro features.
Important: If you do not cancel the subscription before the free trial ends, your iTunes account will be automatically charged for the selected subscription plan. You can cancel the free trial at any time in your iOS subscription settings.
Free trial eligibility is determined by Apple and is typically available only once per Apple ID. Any unused portion of a free trial will be forfeited when you purchase a subscription.
When using Tempo, including the Together feature, you agree to:
Together groups are private and invite-only, with a maximum of 8 members per group. Group access is controlled through 6-character invite codes shared at the discretion of group creators and members.
The Tempo application, including but not limited to its design, graphics, user interface, code, features, and all related content, is the property of Qingdao Tianji Intelligent Technology Co., Ltd. (青岛天机智能科技有限公司) and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You may not:
All data you create within the App (habits, focus sessions, group data) remains your property. We do not claim ownership of your personal data.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Tempo is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, Qingdao Tianji Intelligent Technology Co., Ltd. (青岛天机智能科技有限公司) and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to these Terms or the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.
Tempo is a productivity and habit tracking tool. It is not intended to provide medical, psychological, or therapeutic advice. The Pomodoro timer and habit tracking features are productivity aids and should not be used as substitutes for professional health or medical guidance.
You may stop using Tempo at any time by deleting the App from your device. You may also delete your data through the App's settings prior to uninstallation.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, including but not limited to:
Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) shall continue in effect.
We reserve the right to modify these Terms at any time. When we make material changes, we will:
Your continued use of Tempo after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue your use of the App.
We encourage you to review these Terms periodically to stay informed of any updates.
These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or your use of the App shall be resolved through friendly negotiation. If negotiation fails, the dispute shall be submitted to the competent court in the jurisdiction where Qingdao Tianji Intelligent Technology Co., Ltd. (青岛天机智能科技有限公司) is located.
If you are accessing the App from outside of China, you are responsible for compliance with local laws to the extent that they apply.

Tempo 是一款效率和习惯追踪工具，不旨在提供医疗、心理或治疗建议。番茄钟和习惯追踪功能为效率辅助工具，不应替代专业健康或医疗指导。
您可以随时通过从设备上删除应用来停止使用 Tempo。您也可以在卸载前通过应用设置删除您的数据。

Tempo アプリケーションは、そのデザイン、グラフィック、ユーザーインターフェース、コード、機能、およびすべての関連コンテンツを含むがこれに限定されず、青島天機智能科技有限公司（Qingdao Tianji Intelligent Technology Co., Ltd.）の財産であり、適用される知的財産法により保護されています。

当社は以下を保証しません：
適用法により許容される最大限の範囲において、青島天機智能科技有限公司（Qingdao Tianji Intelligent Technology Co., Ltd.）ならびにその役員、取締役、従業員、および代理人は、データの喪失、利益の喪失、のれんの喪失を含むがこれに限定されない、間接的、付随的、特別、結果的、または懲罰的損害について、かかる損害が本アプリの使用または使用不能に起因するものであっても、かかる損害の可能性について知らされていた場合であっても、一切の責任を負いません。

Tempo は生産性向上および習慣追跡ツールです。医療、心理学的、または治療上のアドバイスを提供することを目的としたものではありません。ポモドーロタイマーおよび習慣トラッキング機能は生産性補助ツールであり、専門的な健康または医療指導の代替として使用すべきではありません。
お客様はデバイスからアプリを削除することにより、いつでも Tempo の使用を停止できます。アンインストール前にアプリの設定からデータを削除することもできます。
当社は、以下を含むがこれに限定されない理由により、原因の有無を問わず、いつでもお客様の本アプリへのアクセスを停止または終了する権利を留保します：
契約終了後、お客様の本アプリを使用する権利は直ちに停止されます。その性質上、契約終了後も存続すべき本規約の条項（知的財産権、免責事項、責任制限、準拠法を含む）は引き続き効力を有するものとします。
当社は本規約をいつでも変更する権利を留保します。重要な変更を行う場合、当社は以下を行います：
本規約の変更後も Tempo を継続して使用することにより、お客様は改定された規約に同意したものとみなされます。更新された規約に同意されない場合は、本アプリの使用を中止してください。
最新の更新内容を把握するため、本規約を定期的にご確認いただくことをお勧めします。
本規約は、法の抵触に関する規定にかかわらず、中華人民共和国の法律に準拠し、同法に従って解釈されるものとします。
本規約またはお客様による本アプリの使用に起因する紛争は、まず友好的な協議を通じて解決されるものとします。協議が不調の場合、紛争は青島天機智能科技有限公司（Qingdao Tianji Intelligent Technology Co., Ltd.）の所在地を管轄する裁判所に提出されるものとします。
中国国外から本アプリにアクセスする場合、お客様は適用される範囲で現地の法律を遵守する責任を負います。
